we did a refight of Teugn Hausen and during this Montbrun's cavalry, on a defend order, transitioned to attack and plowed into the flank of an Austrian infantry formation.Â
As it was a flank contact I used the -3 penalty in the combat modifiers. However this got me thinking to what happens if the contacted ployed unit was to the front. Does it fight normally or is it assumed the -3 penalty is applied no matter where the units are contacted ?

Just to clarify, the flank penalty is only for an Assessment taken after the Combat Resolution. And being grand tactically outflanked means there is an enemy between the rear wave and the Reformation Area (or contacting the Reformation Area).
Thus, there is no flank penalty during Combat Resolution just during the Assessment that follows. This means if you strike a ployed Formation, the Units in the ployed Formation fight normally in Combat Resolution, and *after* Combat Resolution is complete, you determine "is the Formation grand tactically outflanked?" and if so apply the Assessment penalty.
The big problem for a ployed Formation being hit so that following the Assessment – during which it likely took *some* Fatigue – it must take a Status Check, and that likely ends in a Retreat [RT] or Break [BK] because it does not have enough deployed Units to withstand the Fatigue.
